Welcome to the North Forge Athletix website, mobile applications, and digital platforms (collectively, the "Site"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and North Forge Athletix ("Company," "we," "us," or "our").

By accessing, browsing, or using this Site, creating an account, or purchasing products, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Return Policies. If you do not agree to these Terms, you must immediately discontinue use of the Site.
 

1. ELIGIBILITY AND SITE USE

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.

• License Grant: We grant you a personal, limited, non-exclusive, non-transferable, and revocable license to access and make personal, non-commercial use of the Site.

• Prohibited Conduct: You agree not to use the Site for any unlawful purpose. Prohibited activities include, but are not limited to:

2. USER ACCOUNTS AND SECURITY

Account Responsibility: You are entirely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to accept responsibility for all active operations, transactions, and purchases that occur under your account.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion if we suspect fraudulent, unauthorized, or illegal activity.
 

3. INTELLECTUAL PROPERTY RIGHTS

All content displayed on this Site—including but not limited to digital apparel designs, graphic artwork, typography, logos, trademarks, text, photographic imagery, video clips, and software code—is the exclusive property of North Forge Athletix or its content suppliers and is protected under United States and international copyright, trademark, and intellectual property laws.

• Trademarks: The names, logos, slogans, and distinctive design motifs associated with North Forge Athletix are proprietary trademarks. They may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among consumers, or in any manner that disparages the brand.

• User-Generated Content: If you post, submit, or tag us in any photos, videos, reviews, or comments ("Submissions"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content across our marketing channels. You represent that you own all rights to your Submissions.
   

4. PRODUCT ORDERS, PRICING, AND QUANTITIES

All product listings, specifications, and pricing displayed on the Site are subject to change at any time without prior notice.

• Order Acceptance: The receipt of an email order confirmation does not constitute our formal acceptance of an order or an offer to sell. We reserve the right, without prior notification, to limit the order quantity on any item or to refuse service to any customer.

• Pricing Errors: In the event that a product is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed or your payment method has been charged. If your payment method has already been charged, a full refund will be issued.

• Custom Production: You acknowledge that certain lines of apparel are custom-manufactured or printed strictly to order. Consequently, fulfillment timelines may fluctuate based on manufacturer logistics and material availability.
   

5. DISCLAIMER OF WARRANTIES

This Site and all content, materials, products, and digital deliverables provided herein are delivered on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

To the fullest extent permissible pursuant to applicable law, North Forge Athletix disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not represent or warrant that the functions contained within the Site will be completely uninterrupted or error-free, or that the Site or the servers that host it are free of technical defects or harmful components.
 

6. LIMITATION OF LIABILITY

In no event shall North Forge Athletix, its directors, officers, employees, affiliates, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site, your inability to use the Site, or the performance and utility of the products purchased through the Site.

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal framework, even if the Company has been advised of the possibility of such damages.
 

7. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless North Forge Athletix, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs—including reasonable attorneys' fees—resulting from any violation of these Terms, any unauthorized activity related to your account, or your wrongful conduct on the Site.
 

8. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms, your access to and use of the Site, and all transactions executed through the storefront shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

 

Arbitration Notice: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be settled by binding, individual arbitration rather than in a court of general jurisdiction, to the fullest extent permitted by law.
 

9. TERMINATION

These Terms remain effective unless and until terminated by either you or us. You may terminate your agreement to these Terms at any time by ceasing all further use of our Site and closing your user account.

We also reserve the right to terminate your access to the Site immediately, without notice, if in our sole judgment you fail to comply with any term or provision of these Terms. Upon termination, you must immediately destroy all materials downloaded or obtained from the Site.
 

10. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms constitute the entire legal agreement between you and North Forge Athletix governing your digital interaction and purchasing relationship with the brand.
